Definitions Ask Find Buy, refers to Ask Find Buy Pty Ltd (ACN 146 916 190) incorporated in Australia and services or products supplied by Ask Find Buy Pty Ltd. Including and not limited to all services available through: www.askfindbuy.com, www.askfindbuy.com/au www.askfindbuy.com/uk www.askfindbuy.com/nz www.askfindbuy.com/us www.askfindbuy.com/ca www.askfindbuy.co.uk www.askfindbuy.co.nz www.askfindbuy.com.au www.askfindbuy.ca You, refers you as any person or organisation using services supplied by Ask Find Buy. Services, refers to any service or product available or accessible through Ask Find Buy or supplied by Ask Find Buy including documents, video, buyer information and websites. Terms and Conditions 1. Terms of use 1.1 These Terms and Conditions are universal to all services supplied by Ask Find Buy unless stipulated as being superseded by terms and conditions for a product supplied by Ask Find Buy. 1.2 You are responsible for obtaining independent legal advice regarding the use of Ask Find Buy. 2. Accepting the terms 2.1 By accepting the Terms and Conditions you are agreeing to them and to be limited to action specified in them in regard to Ask Find Buy. They form a legal agreement between you and Ask Find Buy. 2.2 By creating an Ask Find Buy seller account you are by action accepting the Terms and Conditions of Ask Find Buy. 3. Provision of service by Ask Find Buy 3.1 Ask Find Buy makes no promises about the availability to services. 3.2 Ask Find Buy may, with no prior notice to you, suspend or cancel services with no explanation. 3.3 Ask Find Buy reserves the right to cancel or suspend access to Ask Find Buy services to any or all users of Ask Find Buy with not prior notice. 3.4 You agree that Ask Find Buy has the right to cancel or suspend any user (including you) with no compensation to that user (or you) for the cancel or suspension. 4. Using the service 4.1 You can only use the service as described in the user documentation. Using Ask Find Buy for any purpose other than the one described may result in suspension or cancellation of your account without notice. 4.2 You agree that all information supplied by Ask Find Buy is educational in nature and has no warranty or guarantee attached regarding reliability, accuracy or appropriateness. 4.3 You acknowledge and agree that Ask Find Buy supplies no warranty or guarantee regarding the quality of the sales leads generated obtained through Ask Find Buy. 4.4 Ask Find Buy will supply sales lead information when a customer enquiry matches based on the Ask Find Buy algorithm “Initial Lead Email”. This initial email will contain the enquiry and post code data. This is supplied at no cost to you. 4.5 You acknowledge and agree that by clicking on a link in the Initial Lead Email you will be purchasing the “Full Sales Lead” which contains the “Initial Sales Lead” as well as the email address supplied by the person entering the enquiry. 4.6 You acknowledge and agree that by clicking the link as described in 4.5 that the amounted stated in the “Initial Lead Email” will be added to your account. 4.7 You acknowledge and agree that they are no way to set the maximum limit on an account and it is your responsibility to monitor your account through the Ask Find Buy interface. 4.8 You acknowledge and agree that Ask Find Buy has the right to debit the Credit Card you specified during the creation of your Ask Find Buy account with any outstanding balance. 4.9 Ask Find Buy generates and invoice once a month for fees generated in previous months. 4.10 You acknowledge and agree that Ask Find Buy has the right to debit the Credit Card you specified only when the outstanding amount reaches a level that Ask Find Buy deems appropriate. 4.11 You acknowledge and agree that it may be necessary for Ask Find Buy to debit the Credit Card supplied to times outside the normal billing cycle. 4.12 You acknowledge and agree that dishonoured transaction fees will be added to your account balance and will be payable by you as part of your next invoice. 4.13 You acknowledge and agree that Ask Find Buy has the right to cancel or suspend an account for unpaid outstanding balances or dishonoured payments. 5. Password Security 5.1 You acknowledge and agree that you are responsible for the protection of your password to access Ask Find Buy. 5.2 You acknowledge and agree that Ask Find Buy can not supply you with a copy of your password as Ask Find Buy stores this data in a format not readable by humans. 5.3 You acknowledge and agree that you will reset your password using the “Forgot Password” function in the Ask Find Buy interface if you do not have access to your password or can not remember the password. 6. Privacy and Spam 6.1 You acknowledge and agree that Ask Find Buy reserves the right to cancel your account and deny you access to all Ask Find Buy services for breaches of the Ask Find Buy spam policy (6.2). 6.2 You can not or allow your Ask Find Buy account or related service to be used to collect contact details that will be used for Spam. 6.3 You acknowledge and agree that contact details will only be used to contact the customer regarding the product or service the customer used Ask Find Buy to enquire regarding. 6.4 Ask Find Buy will not distribute contact details to any parties unless specifically stated in an agreement or stated at the time of collection. 7. Service supplied 7.1 Ask Find Buy supplies sales leads via email to you based on criteria and keywords you specify. 7.2 Ask Find Buy supplies educational documents, video and information in other physical and electronic forms. You acknowledge and agree that this information is educational in nature and no promise, warranty or guarantee has been made regarding its quality, accuracy or appropriateness. 8. Ask Find Buy proprietary rights 8.1 Ask Find Buy owns the name “Ask Find Buy” all it’s logos and other artifacts. 8.2 Ask Find Buy owns the algorithm which is used to match customers to your criteria and keywords. 8.3 You acknowledge and agree that Ask Find Buy owns and has all rights to data generated by the use of the service. You acknowledge and agree that you have no rights to this data and that any data supplied by Ask Find Buy come with no right attached. 9. Ask Find Buy updates and changes to service 9.1 You acknowledge and agree that Ask Find Buy has the right to change, alter, introduce or remove any part or all of any element or service supplied by Ask Find Buy. 10. Closing your Ask Find Buy account 10.1 You can cease using Ask Find Buy at any time without notification to Ask Find Buy. 10.2 You acknowledge and agree that you are responsible for maintenance of Criteria and Keywords and this maintenance can be used to prevent the generation of “Initial Lead Email”. 11. Ask Find Buy responsibilities 11.1 Ask Find Buy is responsible for security of data collected through Ask Find Buy. 11.2 You acknowledge and agree that Credit Card details are stored by a third party on a secured and fully compliant server. The provider of these services is currently Eway www.eway.com.au 12. Limitation to liability 12.1 You acknowledge and agree that Ask Find Buy is not and can not be held responsible for any and all damaged caused by the use of Ask Find Buy. 12.2 You indemnify Ask Find Buy from all claims, including but not limited to, damages direct or consequential relating to you and your use of Ask Find Buy and it’s services, information and or products. 13. Copyright 13.1 Ask Find Buy retains all copyright to material generated by the services of Ask Find Buy. 13.2 Ask Find Buy retains all copyright to material on the Ask Find Buy websites, including but not limited to; documents, videos, FAQs and Blog posts.
